This API & Data License Agreement (“Agreement”) is a legally binding contract between you (“Licensee”) and NETLAS LLC (“Netlas,” “we,” “us,” or “our”), governing your access to and use of the Netlas API (“API”) and data provided through the API or as separate datasets (“Data”).
By accessing or using the API or Data, you agree to be bound by this Agreement. If you do not agree, you must discontinue use immediately.
1. Scope and availability
API access is available to every registered Netlas user. The specific features, limits, and rights available to you depend on your plan.
2. License Grant
Netlas grants you a non-exclusive, non-transferable, revocable, limited license to access and use the API for the purpose of retrieving Data as permitted by this Agreement and in compliance with the Netlas Terms & Conditions.
Netlas offers different pricing plans with varying rights to Data usage. The current plans and pricing are published on our plans page and may change from time to time. Any changes apply prospectively and may take effect on your next purchase or renewal:
- Community Plans: Data is for personal, non-commercial use only and may not be resold or redistributed.
- Paid Plans: Data may be used for commercial purposes, including providing services to your clients.
Unless your Certificate of Entitlement includes the resale/white-label option, you may not resell, sublicense, or distribute the Data.
3. Usage Restrictions
You agree not to:
- Use the API or Data in a manner that violates any applicable law or regulation.
- Access the API in a way that exceeds rate limits or otherwise circumvents technical restrictions.
- Store, modify, or redistribute the Data for resale unless your pricing plan explicitly allows it.
- Share API keys or access credentials with third parties.
- Use the API to create a competing product or service.
- Use the Data in a way that could harm individuals, violate privacy laws, or be used for illegal activities.
Prohibited Community Account Misuse:
- Community plans have strict limits and may not be used to bypass restrictions.
- Creating multiple Community accounts to evade limits is strictly prohibited.
- Violation of this policy may result in account termination and permanent banning from Netlas services.
4. Data Retention & Compliance
- You may store Netlas Data only for the period necessary to fulfill your business or research purposes, subject to your plan and applicable law.
- You are responsible for ensuring compliance with GDPR, CCPA, and other applicable privacy laws when handling personal or sensitive data.
- You are responsible for ensuring your retention and use of Data complies with applicable law.
5. API Access & Limitations
- Rate limits and usage quotas vary based on your pricing plan and are enforced by technical controls.
- Netlas reserves the right to modify, suspend, or terminate API access at any time without prior notice.
- API access credentials must be kept secure. You are responsible for any actions performed using your API key.
6. Intellectual Property
All rights, title, and interest in the API and Data remain with Netlas. This Agreement does not grant you ownership of the API, Data, or any related intellectual property, but provides a limited license to access and use the API and Data as described in this Agreement.
7. Fees & Payment
- Access to certain API endpoints or datasets may require a paid subscription or one-time fee.
- Payment terms are defined in your subscription plan or purchase agreement.
- No refunds are provided, except where required by law. All sales are final.
- Failure to pay required fees may result in suspension or termination of access.
8. Conflicts
If there is a conflict between this Agreement and the Netlas Terms & Conditions regarding API or Data usage, this Agreement controls.
9. Amendments
Netlas reserves the right to modify this Agreement at any time. We will notify you by email when changes are made. Continued use of the API or Data after changes are posted constitutes acceptance of the revised Agreement.
